Terms of Service

The terms that govern access to and use of the Scaleapp learning platform.

1. Agreement and service

These Terms govern access to and use of the online learning management system and related services provided by Scaleapp Education AB, a company based in Sweden ("Scaleapp," "we," "us," or "our"). By using the Service, a customer and its authorized users agree to these Terms.

If you accept these Terms for an organization, you confirm that you have authority to bind that organization. Scaleapp may update the Service, including its features and functionality, over time.

2. Accounts and access

Customers must provide accurate account information and keep access credentials confidential. Each customer is responsible for activity conducted through its workspace and for promptly reporting suspected unauthorized access.

Scaleapp may suspend or restrict access where use materially violates these Terms, applicable law, or platform security requirements.

3. Customer data

Customer content, learner records, course materials, media, assessments, messages, and other data submitted to the Service remain the customer's data. Scaleapp does not claim ownership of customer data.

Customers grant Scaleapp the limited right to process customer data only as needed to provide, secure, maintain, and support the Service. Scaleapp does not sell customer data or use it for advertising.

4. Data protection

Where Scaleapp processes personal data for a customer, the parties will apply the data-processing terms and instructions appropriate to their relationship. Customers remain responsible for determining the lawful basis and notices required for their learners and users.

5. Scaleapp intellectual property

Scaleapp and its licensors retain all rights in the Service, documentation, software, platform design, and underlying technology. Except as expressly allowed in writing, customers may not copy, reverse engineer, resell, sublicense, or create derivative works from the Service.

6. Customer responsibilities

Customers agree to use the Service lawfully and responsibly.

  • Maintain accurate records of authorized users and administrators.
  • Ensure customer data and learning content do not infringe third-party rights.
  • Obtain any required permissions or notices for uploaded data and assigned learners.
  • Keep harmful code, malware, and unlawful content out of the Service.

7. Prohibited conduct

  • Attempting to gain unauthorized access or bypass platform controls.
  • Interfering with the availability, integrity, or security of the Service.
  • Using the Service for unlawful, abusive, defamatory, or fraudulent purposes.
  • Uploading malicious files or content intended to harm users or systems.

8. Availability and support

Service levels, support coverage, maintenance windows, response targets, and any service credits are governed by the applicable order form, service plan, or enterprise agreement. Scaleapp may schedule maintenance and deploy security updates as needed to operate the Service responsibly.

9. Third-party services

Scaleapp may use vetted providers for infrastructure, communications, analytics, payments, or other operational functions. Any applicable subprocessor information and contractual commitments are governed by the relevant service documentation and data-processing terms.

10. Fees and subscriptions

Fees, subscription periods, invoicing, renewal, and payment terms are set out in the applicable commercial agreement. Scaleapp may suspend access for material non-payment, subject to any agreed notice and cure periods.

11. Changes to these Terms

Scaleapp may update these Terms from time to time. Material changes will be communicated through an appropriate channel before they take effect where required by applicable law or agreement.

12. Termination and data export

Either party may end access as provided in the applicable commercial agreement. Upon termination, customers may request export of customer data during the period specified in that agreement or applicable data-processing terms.

13. Security and confidentiality

Scaleapp applies technical and organizational measures appropriate to the Service and treats non-public customer information as confidential. Each party must protect the other party's confidential information, except where disclosure is required by law or authorized in writing.

14. Disclaimers and liability

The Service is provided subject to the warranties, limitations, and liability provisions in the applicable commercial agreement. Nothing in this page changes mandatory rights that cannot be excluded under applicable law.
